1. Acceptance of Terms
By accessing and using Facturia (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these terms, you must not use our service.
These terms constitute a legally binding agreement between you and SME Analytica
2. Description of Service
Facturia is a software platform that facilitates compliance with Spanish electronic invoicing regulations, specifically the AEAT VeriFactu system.
The service includes:
- Invoice management and storage
- Automatic submission of information to the AEAT
- Digital document signing
- Client and supplier management
- Regulatory compliance reports
- Specialised technical support
3. Registration and User Account
3.1 Registration Requirements
- Be a legally constituted company in Spain or a foreign company operating in Spain
- Provide truthful and up-to-date information
- Have a valid NIF/CIF
- Possess a valid digital certificate
3.2 User Responsibilities
- Maintain confidentiality of your credentials
- Immediately notify any unauthorised use
- Update account information when necessary
- Comply with all applicable laws and regulations
4. Acceptable Use
Permitted Uses
- Legitimate business invoicing management
- Compliance with tax obligations
- Normal commercial use of the service
Prohibited Uses
- Illegal or fraudulent activities
- Violation of third-party rights
- Reverse engineering of the software
- Use that compromises system security
- Resale or redistribution of the service
5. Pricing and Billing
5.1 Subscription Plans
Autónomo
19,99 EUR/month — 30 invoices, 10 clients, 20 AI questions
Profesional
39,99 EUR/month — 200 invoices, unlimited clients, 100 AI questions
Empresa
79,99 EUR/month — 700 invoices, unlimited clients, 1000 AI questions
5.2 Payment Conditions
- Monthly billing in advance
- Payments processed automatically
- Service suspension for non-payment after 7 days
- Automatic cancellation after 30 days of non-payment
6. Service Availability
Service Level
- Target availability: 99.9% monthly
- Scheduled maintenance: 48h advance notification
- Technical support: Monday to Friday 9:00-18:00
We strive to keep the service available, but do not guarantee uninterrupted operation. Interruptions may occur due to maintenance, updates, or circumstances beyond our control.
7. Intellectual Property
The Facturia service, including software, design, content and trademarks, is owned by SME Analytica and is protected by intellectual property laws.
Your Data
You retain all rights to your invoicing data and business information.
Our Software
We grant you a limited licence to use our software according to these terms.
8. Limitation of Liability
Important
To the maximum extent permitted by law, SME Analytica shall not be liable for indirect, incidental, special or consequential damages.
Specific exclusions:
- Loss of profits or revenue
- Loss of data (beyond restoration)
- Business interruptions
- AEAT penalties for user errors
Our total liability shall not exceed the amount paid for the service in the 12 months preceding the event giving rise to the claim.
9. Termination
9.1 Termination by User
You may cancel your subscription at any time from your account settings. Cancellation will be effective at the end of the current billing period.
9.2 Termination by Us
We may suspend or terminate your account for breach of these terms, non-payment, or misuse of the service, with prior notice when possible.
9.3 Effects of Termination
- Immediate suspension of service access
- Data available for export for 30 days
- Permanent data deletion after 90 days
10. Governing Law and Jurisdiction
These terms are governed by the laws of Spain. Any dispute shall be resolved by the courts of Madrid, Spain.
Dispute Resolution
Before initiating any legal proceedings, the parties shall attempt to resolve disputes through good faith negotiation for a period of 30 days.
